Mind Muscle Fitness LTD – Membership Terms & Conditions

These Terms and Conditions (“Terms and Conditions”) and the Gym Rules (available at mindmusclefitness.co.uk/gym-rules) apply to all users of Mind Muscle Fitness LTD, whether attending as a member or as a guest. By using the gym, you agree to be bound by these Terms and Conditions and the Gym Rules.

1. Quick Guide to Key Terms (Summary Only)

  • Membership fees must be kept up to date.

  • You must follow all Gym Rules: mindmusclefitness.co.uk/gym-rules

  • The gym is mostly unsupervised — you exercise at your own risk.

  • We are not responsible for loss/theft of personal belongings unless caused by our negligence.

  • You must not share your personal PIN or allow tailgating.

  • A 14-day cooling-off period applies to online purchases.

  • Memberships may be cancelled with 30 days’ notice (applies to 6-month and monthly rolling memberships).

  • We may cancel your membership for rule breaches, non-payment, or safety concerns.

  • Personal training is provided by self-employed trainers under separate agreements.

3. How to Join

Before using the gym, you must:

  1. Complete the online or in-person sign-up form.

  2. Confirm that you have read and agree to the health declaration.

  3. Accept these Terms and Conditions and the Gym Rules.

  4. Pay any joining and membership fees required for your selected membership.

We may refuse membership if you previously breached our terms or if your use could pose a risk to yourself, others, or our business.

A binding contract begins when we confirm your membership by email.

You must keep your details and payment information up to date.
Memberships are personal and cannot be transferred or shared.

4. Membership Types

We offer the following:

4.1 Six-Month Contract (Paid Monthly by Direct Debit)

  • Includes a joining fee.

  • Runs for a fixed 6-month period.

  • Members may cancel with 30 days’ written notice, but cancellation cannot take effect earlier than the end of the 6-month term unless required by law or supported by valid medical evidence (see Cancellation section).

4.2 Monthly Rolling Membership (Direct Debit)

  • Includes a joining fee.

  • Continues indefinitely until cancelled.

  • Members may cancel at any time with 30 days’ written notice.

4.3 Annual Membership (Paid in Full by Card)

  • No joining fee.

  • Covers 12 months from the start date.

  • Non-refundable after the 14-day cooling-off period.

4.4 Day Pass (Card Payment)

  • Valid only for the date selected at purchase.

  • Non-transferable and non-refundable (unless within cooling-off period and not yet activated).

5. Freezing Your Membership

  • Membership may be frozen for up to 2 months per year.

  • Longer freezes require medical evidence.

  • Freezing does not shorten the length of the 6-month contract term.

  • Direct debit payments pause during a freeze unless otherwise agreed.

6. Access & Security

  • Access is via a personal PIN.

  • Gym hours: 5:00am – 11:00pm, 7 days a week.

  • CCTV operates throughout the facility (except changing rooms).

6.1 PIN Policy

  • PINs must not be shared.

  • Tailgating (allowing someone in behind you) is prohibited.

  • Misuse may result in:

    • A written warning

    • A penalty equal to the value of a day pass

    • Cancellation of membership without refund

7. Exercising Safely

The gym is primarily unsupervised. You are responsible for ensuring you can exercise safely.

Your responsibilities:

  • Ensure you are medically and physically able to exercise.

  • Use equipment appropriately and only if you understand how to do so safely.

  • Work within your own limits.

  • Familiarise yourself with emergency exits.

  • Report injuries or concerns promptly.

Inductions

Optional but recommended for beginners.
Inductions do not change your responsibility for safe exercise.

8. Age Restrictions

  • Minimum age for membership: 18.

  • 16–17-year-olds may use the gym only with a supervising adult member.

  • Under 18s may not use the gym unsupervised.

9. Cooling-Off Period

You may cancel within 14 days of joining.

If you have already used the gym, we will deduct a proportionate amount for usage.

Day passes may only be refunded if unused and the start date is more than 14 days away.

10. Membership Fees & Payment

  • Direct debits are collected monthly.

  • Failed payments may result in:

    • Admin fees

    • Suspension of access

    • Membership cancellation

We will give 30 days’ notice of any membership price changes.

11. Cancellation of Membership

This section includes the newly added 30-day notice period.

11.1 Monthly Rolling Memberships

  • You may cancel at any time with 30 days’ written notice.

  • Notice must be provided via email or member account (if applicable).

  • Direct debit payments must continue during the 30-day notice period.

  • Membership ends once the 30 days have passed.

11.2 Six-Month Contract Memberships

  • You may cancel, but cancellation requires 30 days’ notice in writing.

  • Cancellation cannot take effect before the end of the 6-month term, unless:

    • Required under consumer law, or

    • Supported by a doctor’s letter confirming you cannot exercise for medical reasons.

11.3 Annual Membership

  • Non-refundable after the 14-day cooling-off period.

  • Cannot be cancelled mid-term unless required by law.

11.4 Day Passes

  • Cannot be cancelled once activated or once the date has begun.

  • Non-transferable.

12. Our Right to Cancel

We may cancel your membership immediately if:

  • You fail to pay fees.

  • You share your PIN or allow tailgating.

  • You attend under the influence of alcohol, drugs, or unsafe medication.

  • You behave aggressively or inappropriately.

  • You repeatedly breach Gym Rules.

  • You pose a safety risk or reputational risk.

No refunds will be issued if cancelled for misconduct.

13. Our Responsibilities & Liability

We are responsible for:

  • Complying with health and safety laws

  • Keeping equipment maintained

  • Providing services with reasonable care

We are not responsible for:

  • Injuries due to misuse of equipment

  • Accidents caused by ignoring Gym Rules

  • Lost or stolen belongings

  • Personal training services (delivered by self-employed trainers)

  • Unforeseeable losses

Your consumer rights remain unaffected.

14. Temporary Closures

The gym may close temporarily for maintenance, safety, or operational reasons.

  • Membership fees will still be charged during temporary closures.

  • If closure exceeds 72 hours, compensation may be offered at our discretion.

  • You may still cancel with required notice (30 days for applicable memberships).

15. Lockers & Personal Belongings

  • Lockers may be used during your visit only.

  • Items left overnight may be removed.

  • We are not responsible for loss or theft of personal belongings.

16. Facilities

We provide:

  • Changing rooms

  • Toilets

  • Showers

Please maintain hygiene and respectful behaviour at all times.

17. Personal Training

  • Personal trainers are self-employed but operate under the Mind Muscle Fitness brand.

  • PT sessions require an active membership.

  • PT services are governed by separate PT Terms & Conditions.

  • Payments for PT services are made directly to the trainer.

18. Guest Passes

  • Guest passes may be requested and may incur a fee.

  • Guests must complete the health declaration and follow all rules.

  • Members are responsible for their guest’s behaviour.

19. Behaviour & Conduct Policy

Zero tolerance for:

  • Harassment

  • Intimidation

  • Aggression

  • Unsafe behaviour

  • Disrespecting staff or members

Breaches may result in immediate membership termination without refund.

20. Promotions

Promotions and offers are separate from standard memberships and have their own terms.

21. Changes to Services or Terms

We may make changes:

  • To comply with law

  • For safety or security

  • For minor operational reasons

If a change significantly affects your membership, we will notify you and provide the option to cancel (with 30 days’ notice where applicable).

22. Transfer of Agreement

We may transfer our rights/obligations to another company without affecting your rights.
You may not transfer your membership.

23. Governing Law

These Terms are governed by the laws of England and Wales.
Disputes will be handled in the courts of England and Wales.

24. Personal Information

We process your data according to our existing Privacy Notice.
